General

1.1 All Eventko.eu online store services are in accordance with the Consumer Protection Act (ZVPot-UPB2) and on the basis of internationally recognized codes and recommendations of the Chamber of Commerce and Industry, provided by the company LEGIT d.o.o. Ljubljana, Črnuče (hereinafter “the provider”), tax number SI52069869 with registration number SRG2016/39005.

1.2 The client or customer (can also be user) hereinafter means: physical person, self-employed person, individual, company or organization to which the provider provides services.

1.3 The terms of business apply to all services provided by the provider and deal with user rights, the operation of Eventko, and all legal or business relations between the provider and the buyer, under all business conditions.

1.4 A buyer who wants to make a purchase on the Eventko.eu page or to obtain the right to it must first register. The username is the same as his email address. The user name and password, which the visitor with confirmed registration receives by e-mail, unequivocally identify the user and associate them with the entered data. The user can change the password independently, but to change the username or email address, a change request must be sent to [email protected]. The user will be notified of the change by e-mail.

Obligations of the provider and the customer

2.1 The recorded data and information on the Eventko website are accurate. There may be an error with certain records or information, and if the record is incorrect, please inform us about it. If you decided to buy a product based on an incorrect entry, you can return the product.

2.2 The provider assures that the services will be provided in good quality and within the agreed deadline.

2.3 The provider agrees to always provide the customer with:

  • company identity (name and headquarters and register number)
  • contact information for fast and efficient communication (e-mail address)
  • essential characteristics of goods or services (including after-sales services and guarantees)
  • availability of items in the offer (within an reasonable period)
  • terms of delivery of items or performance of service (place, method and deadline of delivery)
  • in order for all prices to be clearly and unambiguously determined, it must be clear whether they already include taxes and transport costs
  • information about the method of payment and delivery
  • data on the time validity of the offer
  • information about the period during which it is still possible to withdraw from the contract and the conditions for withdrawal (including if and how much it costs the client to withdraw from the contract)
  • explanation of the complaint procedure (together with all information about the contact person or customer service department)

2.4 The entry of personal data during registration and during subsequent online purchases on the Eventko page is necessary exclusively for the correct performance of services. The data provider will never transfer, rent, sell or otherwise trade your personal data. Also, your personal data will never be used in a way that you do not support or you don’t agree with.

2.5 Orders received by 9:00 a.m. (CET) are treated as orders received on that day, so the deadline begins on that day. The agreed deadlines can be changed in the event of force majeure, such as a natural disaster, a power outage for a longer period of time or a longer disruption in the internet.

Change of Terms and Consent

3.1 Eventko reserves the right to change the general conditions without prior warning. Changes come into effect the moment they are published and are valid from that moment onwards. The general terms and conditions are always available on the store’s website, and for all questions about changes to the general terms and conditions, we are available via [email protected].

3.2 By using the services and registering in the online store, you agree that you are aware of and fully agree with all the stated conditions.

Offer of products or services

4.1 Due to online business, product offers or or services are changing often and quickly. In the event of an identified error or incorrect entry on the part of the provider, Eventko assumes responsibility for resolving the error or complaint.

Ordering and purchase process

5.1 In the Eventko online store, products are purchased exclusively online (internet). Orders placed are considered final. In the case of a wrong order or cancellation, the buyer can correct or cancel his order only until he receives the email message “Your order is complete!”. After receiving this message, cancellation is no longer possible. In the event that Eventko finds that it cannot fulfill the order under the stated conditions, it reserves the right to refuse the order and refund the purchase price (Article 6.2, or unavailability of products in a longer period of time, or non-delivery of the product (EOL – end of life)). The rejection of the order by the provider may occur before the notification “Your order has been completed” is received.

5.2 The purchase procedure is as follows:

  • The buyer adds the desired product to the basket on the Eventko website.
  • The customer is automatically redirected to the basket page where he can see an overview of the ordered products.
  • The buyer clicks the “Continue with order” button, which redirects him to the checkout page.
  • The customer fills in all the necessary fields (name, surname, address, phone number, e-mail address, coupon code) or logs into an existing account. A user account is not required for purchase.
  • The buyer can choose between different payment methods (credit cards, cash on delivery, Paypal…)
  • The buyer must agree to the general business conditions and privacy policy before completing the purchase.
  • If the buyer does not fill in all the required fields, the system clearly warns him of this and marks the missing field.
  • After placing the order, the buyer receives a confirmation of the accepted order by e-mail.
  • If the customer has a registered Eventko account, he can check the details and order status on the Eventko website. Customers will also receive additional information about the order by e-mail.
  • The provider reviews the order (checks the deadline and the possibility of delivery of the ordered items). In some cases, the provider can also contact the buyer by phone or email (checking data, ensuring delivery accuracy, etc.)
  • When the order is sent (electronically or by mail), the buyer receives a confirmation email status “Your order is complete”, and the order changes to Completed. The message contains information on who the buyer can contact in the event of a delay in delivery, return of goods and in the event of a complaint ([email protected]).
  • The delivery time in the case of physical delivery depends on the delivery partner (Pošta Slovenije, GLS or DHL) and in most cases takes 1-3 working days for Slovenia and Croatia and 3-21 days for the rest of the world if we allow shipping to foreign countries,

For goods that the provider does not have in stock in its own warehouse, the latter is exclusively bound to the delivery by the provider’s supplier and to the time during which the provider’s supplier can deliver the goods to the provider, while the provider informs the buyer about the progress of the delivery. If the delivery time is very long and the buyer does not want to wait, the buyer can notify the provider, who will remove the item from the order and return any funds already paid to the buyer, and deliver the other items from the order at the buyer’s choice or cancel the entire order. If the supplier does not confirm the availability of the ordered items to the provider no later than three months from the date of placing the order, the provider may reject the customer’s order on the grounds that the goods are not available. On the day of cancellation, the customer’s order ceases to be valid. The provider does not assume any responsibility for damage caused by longer delivery times or non-delivery of goods that the provider does not have in stock in its own warehouse.

Prices

6.1 All product prices in the Eventko online store include VAT, unless explicitly stated otherwise. The prices in the online store are only valid for orders placed via the online store and for cash on delivery purchases. The online price applies only to registered users, while the regular price according to the price list published in the physical store applies to non-registered users.

6.2 Prices are valid at the time of placing the order and do not have a predetermined validity. The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions. The cost of postage is €4 for Slovenia and Croatia. Shipping costs for other countries are calculated and displayed in the cart and on the checkout page. Electronic products (tickets) will be delivered via e-mail and there is no shipping fee.

The purchase contract between the provider and the buyer is concluded the moment the provider confirms the order, i.e. when the buyer receives the “Order Confirmation” email. From this moment on, all prices and other conditions are fixed and apply to both the provider and the buyer. Discounts, promotional codes, etc. do not add up. The credit of a registered user in Eventko and all funds paid in according to the preliminary invoices do not accrue interest!

Withdrawal from the contract and returns

7.1 The consumer has the right to withdraw from the contract within 14 days after receiving the goods (or after the contract has been signed or the service has been provided) in the case of the purchase of a physical product. Withdrawal from the contract when purchasing an electronic product (ticket) is not possible. Electronic products (tickets) are transferable, except for those that have this expressly written. The customer must notify the provider of withdrawal from the contract with an unequivocal statement or via an e-mail address/send a completed withdrawal form (download the withdrawal form, click me), without having to give a reason for his decision. The return period begins one day after the date of receipt of the goods, when the customer acquires possession of the goods. The only cost charged to the consumer in connection with withdrawal from the contract is the direct cost of returning the goods. The goods must be returned to the seller no later than 14 days after the notification of withdrawal from the contract (submitted form), and the seller must immediately return all payments made to the consumer. The refund is made in the same way as it was received, unless the customer wants a different refund method or the original refund method is not possible. We do not accept return shipments with unpaid postage costs! The refund is made within 14 days after the provider receives the returned goods. After the 14-day period, it is no longer possible to return the goods.

The goods received must be returned undamaged and in the same quantity, except in the case where the goods are destroyed, lost, damaged or their quantity has decreased through no fault of the consumer.

The customer can exercise his rights from a material defect if he informs the seller about the defect within two months from the day the defect was discovered. The seller is not responsible for material defects in the goods that appear after two years have passed since the product was delivered or received.

In accordance with point 12 of Article 43 of the Consumer Protection Act, the consumer does not have the right to withdraw from the contract for leisure services where the company undertakes to fulfill its obligation on a specific date or within a specific period. According to the stated legal exception, according to which the consumer has no right to withdraw from the purchase of tickets, all ticket orders are binding, regardless of the order method (by phone, email or online). Tickets for all events in Slovenia and abroad, which were purchased via the eventko.si website, cannot be returned or requested for a refund. In the event of cancellation of the event, eventko.eu will automatically cancel all orders within 14 days and return the purchase amount in the same way as the purchase was made. In the event of a change in the date of the event, the buyer may request a refund.

Security, personal data protection and communication

8.1 The provider uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments. For these purposes, the provider uses a 256-bit SSL certificate issued by an authorized organization. Secure authorizations and credit card transactions are handled by PayPal, Aircash or Adyen. Credit card authorizations are carried out in real time with immediate verification of data from banks. We do not store credit card numbers or any information related to online payments.

We are committed to the permanent protection of all personal data of the user. We will carefully protect the data you provide when registering and ordering goods.

The provider indefinitely stores the IP addresses of all visitors to the Eventko online store, and for registered members: first and last name, e-mail address, contact phone number, primary address and delivery addresses, country of residence, time and date of registration and archive of communication with the provider. The provider will use personal data exclusively for the purposes of fulfilling the order (sending informative material, offers, invoices) and other necessary communication.

Under no circumstances will the user’s data be given or sold to unauthorized persons. The user himself is also responsible for the protection of personal data, namely by ensuring the security of his username and password and the appropriate software (antivirus) protection of his computer.

8.2 The provider will contact the customer via remote communication means, unless the customer expressly objects to this.

Advertising emails will contain

  • a clearly presented sender of the message,
  • clear and unambiguous designation of the message as an advertising message,
  • clear labeling of various promotions, campaigns and other marketing techniques,
  • a clear indication of how to participate in them,
  • a clearly presented method of unsubscribing from receiving advertising messages.
  • If the customer declares that he does not want to receive any advertising messages, the provider will respect his decision and take it into account.

8.3 Reviews of online store users and product reviews written by customers are part of the functionality of the store. They are intended for user communities. Any buyer of the Eventko online store can write an opinion, but the provider reserves the right to refuse or delete offensive, inappropriate and useless opinions or comments before final publication. By submitting an opinion or comment, the user expressly agrees to the terms of use and allows the provider to publish part or the entire text in all electronic and other media. The provider has the right to use the content indefinitely and for any purpose that is in the provider’s business interest, including publication in advertisements or other marketing communications. At the same time, the author of the opinion declares and guarantees that he is the owner of the material and moral copyrights for the written opinions and comments, and that he transfers these rights to the provider non-exclusively and indefinitely.

Warranty and service

9.1 The warranty period begins on the day of delivery or acceptance of the ordered products. The warranty for the product is given by the manufacturer or the importer, who is responsible for the warranty conditions. Through the Eventko online store, you can only claim the warranty for products purchased in the Eventko store.

The warranty for the product can be seen from the attached warranty card. The warranty period does not apply to the software! Consumables subject to constant wear and tear (strips, development units, batteries, etc.) are also excluded from the warranty. A product that breaks down during the warranty period is repaired or is replaced within 30 days at the latest, if this is not possible, at the buyer’s request, it is replaced with a new and flawless one, or if this is not possible, the purchase price is returned.

Products delivered to the service outside the warranty period will be repaired or forwarded to an authorized service center as soon as possible. With this, the customer assumes all repair costs (work, material, delivery…). Service work and materials are billed according to the valid price list or the offer of the company Eventko or authorized service. In case of exchange of products, the exchange is made after the prior payment of said products. The customer can take his products only after the prior settlement of all obligations.

The warranty period for individual products can be found in the detailed product descriptions. The general warranty for all physical products is 2 years, unless stated otherwise. The warranty does not apply to consumables and drinks. You can claim the warranty with the original invoice or with a copy and warranty card. Defective goods can be delivered to the store’s headquarters or to an authorized service center. The warranty does not apply in case of improper use, mechanical damage, service interventions by unauthorized persons… If there is no information about the warranty, the product does not have a warranty or the information is currently unknown, the buyer can contact the provider who will provide up-to-date information.

After the warranty expires, we offer service in exchange for payment. You can get the cost or offer for the repair via e-mail.

Payment options

10.1 By placing an order in the Eventko online store, the buyer agrees to settle the purchase price according to the selected payment method. The provider allows the following payment methods:

  • advance payment by direct bank transfer based on the sent invoice or offer (only selected countries, online price applies)*,
  • payment via PayPal (for payments via the PayPal online provider, the price is 5% higher due to the provider’s costs)
  • cash on delivery directly to the post office (only selected countries),
  • Adyen payment by credit card (MasterCard, Visa, Maestro, AE…),
  • Aircash

10.2 The provider will send the customer an invoice via e-mail, with the costs broken down. The buyer is obliged to check the correctness of the information on the invoice and to notify the seller of any errors within eight days of receipt. After these eight days of receipt we no longer consider objections regarding the correctness of issued invoices! The sales contract (order with the status Completed) is stored in electronic form on the server of the provider and is accessible to the customer at any time in his user profile (My profile). At the time of purchase, the merchant is obliged to issue you an invoice.

Delivery

11.1 The provider will deliver the goods or services within the agreed time. The contractual partner for the delivery of shipments is Pošta Slovenije d.o.o.*, GLS d.o.o. or DHL, but the provider reserves the right to choose another delivery service. You must sign the accompanying documents when receiving a shipment via the delivery service.

If the buyer chooses to pay on delivery (available for some countries), he must pay the total cost of the delivered goods and the cost of delivery directly to the delivery company. In some countries, shipping costs for orders over €200 are covered by the provider. After delivery of the goods, the buyer is responsible for visually inspecting the goods for possible damage – both on the packaging and on the products themselves. By purchasing and choosing delivery by the delivery service, the customer agrees that, in order to facilitate communication between the customer and the delivery service, the phone number provided at the time of purchase will be written on the delivery form.

All orders will be shipped within 1-5 business days after the order is placed.

Pošta Slovenije d.o.o. and GLS allow payment in cash or with Mastercard, Maestro, Visa and Karanta cards. When paying with certain credit cards through Pošta Slovenije, there may be additional costs charged by Pošta Slovenije.

In the case of purchasing an electronic product (ticket), there is no postage cost. All electronic products (tickets) will be delivered exclusively via the email address provided during the purchase process. If you entered the wrong email address, please contact [email protected].

The personal data of our users is one of the areas to which we devote extreme care. We make sure that all requirements are met and in some cases even exceeded, because your data and data security is our number one priority.

Cookies

In accordance with the Personal Data Protection Act (ZVOP-1-UPB1), the manager of the online store / website is obliged to protect the personal data of its users.

The provider collects the following user data for the needs of the online store:

  • name and surname,
  • address,
  • email address (your username)
  • contact telephone number
  • password in encrypted form,
  • and other data that users enter in forms on the website.

We are not responsible for the accuracy of data entered by users.

13.2 For security purposes, the IP addresses from which users access the website are also collected. At the start of the visit, each user is assigned a session cookie for identification and monitoring of the shopping basket. Our website may save other cookies on your computer, among others, such as: user identification number in encrypted form (to identify the user on the next visit), item ratings (to know which items you have already rated) and Piwik system cookies (analysis visits to a website hosted on our servers).

All mentioned data, except for cookies, are stored permanently on the server. Session cookies are stored in the server memory only for the duration of the visit and are deleted after one hour of inactivity, while permanent cookies are stored on the visitor’s computer.

The provider can use the data in an anonymized summary form for statistical analysis. Under no circumstances will the provider provide data to unauthorized persons. The delivery service will receive only the necessary data for the successful delivery of the order (name, surname, e-mail address, telephone number and price amount in the case of payment upon delivery). We will contact the user via means of remote communication – unless the user expressly objects to this.

13.3 Exceptional Disclosure of Personal Information

The data we collect and process will only be disclosed if such an obligation is stipulated by law, or in good faith that such action is necessary for proceedings before courts or other state authorities and for the protection and realization of the legitimate interests of Eventko.

13.4. Deletion, unsubscribe and request to print out data

The user can always unsubscribe from receiving electronic marketing messages. The option to unsubscribe will be clearly visible in the footer of each email received (“Unsubscribe”). By clicking on the link, the user will be unsubscribed from receiving additional electronic marketing messages. Due to the nature of the website’s functionality, the user will always receive an email in the event of a forgotten password request. Users can request the deletion of all data stored on the provider’s server related to the email sender by sending “DELETE MY INFORMATION FROM EVENTKO” to the address [email protected]. Due to the nature of the functionality of the website, we reserve the right to remove all user data from the account (email, name/nickname, other data that the user can enter in the profile) and replace it with an automatically generated email address and name that has no connection and does not in any way indicate user’s name or email address. All other data is deleted or replaced with automatically generated characters.

13.5. Users can enter additional information in the profile that is visible to the public, except in cases where it is stated otherwise.

All contact forms on the website are for communication only and the data entered is not used for any additional use (for example: sending promotional emails), except in cases where it is stated otherwise.

All possible disputes related to your purchase will be resolved by the court in Ljubljana. We do not know of any out-of-court consumer dispute resolution providers (click me). For additional information, we are available at [email protected].

Additional information on privacy and cookies

The Electronic Communications Act (Official Gazette of the RS, No. 109/2012), ZEKom-1, introduced new rules into the legal system regarding the use of cookies and similar technologies for storing information or accessing data stored on the user’s computer or mobile device.

The privacy of our users is very important to us, so we strive to provide users with all the information about the cookies we use on our website in order to enable the website to function better and provide a more pleasant user experience.

All obtained information and data will be carefully protected and used exclusively for the needs of providing services.
